So our pod has to shoot the closest unit. Closest unit happens to be a swooping flying monstrous creature or the new Tau command suit that swoops.... sort of.

Easy, 5 tries of 3 snap shots with the Deathspitter load out and we're good.
But, what if your built with Barbed Strangler or Venom Cannon? You cannot shoot at swooping models with blast markers.

So, do you pick the next closest unit as swooping models are not legal targets, or do they hit a logic error and not do anything?

It's the next closest unit it could fire at. If snap firing doesn't allow you to use your weapons, then it wouldn't bother and would go after something it could.

I'm not sure. I don't see anything in the shooting rules that say you can only select targets you can hit or hurt. The only requirement is that the target is in line of sight.

The wording of the Automatic Fire rule that leads me to the conclusion I have is "...this model automatically fires at the nearest enemy unit within range and line of sight...." If you can't actually shoot at the nearest unit because you have a blast template and it's Swooping/Zooming, you can't fire at all, which is contrary to the wording of the rule.

Of course, we all know how great wordsmiths GW authors are when writing clear and concise rules... Obviously, arming with the base Deathspitters leaves no question to what happens. There should've been foresight to address this circumstance.
